Terms of Service

Welcome to AfroCal. These Terms of Service ("Terms") govern your use of the AfroCal mobile application ("the app") developed and operated by Bryte Labs ("we", "us", or "our"). By downloading, installing, or using AfroCal, you agree to be bound by these Terms and our Privacy Policy.

Beta Notice: AfroCal is currently in a free beta phase. Features and pricing are subject to change. A Pro subscription plan is planned for a future release. We will provide advance notice in the app before any paid features are introduced. Your data and meal history will carry over from the beta to the general release.

1. Acceptance of Terms

By accessing or using AfroCal, you confirm that you are at least 13 years old (or 16 years old if you are located in the EU/UK) and agree to comply with these Terms. If you do not agree, do not use the app.

If you are using the app on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of Service

AfroCal is a calorie and nutrition tracking application focused on African cuisine. The app provides:

  • AI-powered food recognition from photos (requires sign-in).
  • Nutritional information and calorie tracking.
  • Meal logging with history and insights.
  • A library of African dishes with nutritional data.
  • Daily nutrition goal setting and progress tracking.
  • Offline meal logging with automatic sync when you sign back in.
  • Barcode scanning for packaged food products.

3. Beta Service

  • AfroCal is currently provided as a free beta service. During the beta period, all features are available at no cost.
  • Beta software may contain bugs, errors, or instabilities. We make no guarantees about uptime or data availability during the beta period.
  • We may add, modify, or remove features during the beta without prior notice.
  • A Pro subscription plan with premium features (including unlimited AI food scans) is planned for a future release. We will notify you through the app before any paid features are introduced, and you will not be charged without explicit action on your part.
  • Your meal data and account information collected during beta will be preserved when the full release launches.

4. Account Registration

  • You may use AfroCal without an account for basic meal logging. An account (via Apple Sign-In) is required to use AI-powered food recognition and to sync your data across sessions and devices.
  • You are responsible for maintaining the security of your Apple ID and any session on your device.
  • You agree to provide accurate information and keep your profile up to date.
  • You are responsible for all activity that occurs on your device under your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

5. Offline Use and Data Sync

  • AfroCal stores your meal logs and food photos locally on your device, allowing you to continue logging meals when you are signed out or offline.
  • When you sign out, your local data is not deleted. Your meals and photos remain on your device.
  • When you sign back in, any meals you logged while signed out are automatically synced to your account. No data is lost.
  • You are responsible for ensuring your device has sufficient storage for local meal data.
  • We do not guarantee that locally stored data will be preserved if the app is deleted, the device is reset, or data is corrupted.

6. AI Food Recognition

AfroCal uses artificial intelligence to identify food and estimate nutritional content. This information is provided for general wellness and informational purposes only.

  • AI food recognition requires an active account (sign-in). Unauthenticated users are not able to access this feature.
  • AI-generated nutritional estimates are approximations and may not be accurate. Results vary based on photo quality, lighting, food preparation, and portion sizes.
  • AfroCal is not a medical device and must not be used as a substitute for professional dietary advice, medical diagnosis, or treatment.
  • If you have dietary restrictions, food allergies, or medical conditions, consult a qualified healthcare professional before relying on nutritional data from this app.
  • We do not guarantee the accuracy, completeness, or reliability of any AI-generated nutritional information.
  • Food images are processed by a third-party AI service (Anthropic Claude API) and are not stored on our servers after analysis. Images are not used to train AI models.

7. User Conduct

You agree not to:

  • Use the app for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to reverse-engineer, decompile, or disassemble the app or its underlying infrastructure.
  • Interfere with or disrupt the app's servers, APIs, or infrastructure.
  • Upload malicious content, spam, or content that violates the rights of others.
  • Attempt to gain unauthorized access to other users' accounts or data.
  • Use automated tools, bots, or scripts to access the app's services.
  • Misrepresent your identity or affiliation in connection with your use of the app.

8. Subscriptions and Payments

  • AfroCal is currently free during the beta period. No payment is required at this time.
  • A Pro subscription plan with premium features is planned for a future release. Before any paid tier is introduced, you will be notified within the app and given the opportunity to review updated pricing.
  • When subscriptions are introduced, they will be billed through Apple's App Store and are subject to Apple's terms, pricing, and refund policies.
  • Subscriptions will automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage or cancel subscriptions in your Apple ID account settings at any time.
  • Refund requests are handled by Apple in accordance with their refund policies. We do not process refunds directly.

9. Intellectual Property

  • AfroCal, its design, code, content, and branding are owned by Bryte Labs and protected by copyright and intellectual property laws.
  • The African food database, dish content, and nutritional data are proprietary to Bryte Labs.
  • You are granted a limited, non-exclusive, non-transferable, revocable licence to use the app for personal, non-commercial purposes.
  • You retain ownership of any photos you capture or upload. By using the food recognition feature, you grant us a temporary, limited licence to process your photos solely for the purpose of providing the food identification service.

10. Privacy

Your use of AfroCal is governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, store, and protect your information, and describes your rights under GDPR, CCPA, and other applicable laws. By using the app, you acknowledge that you have read and understood our Privacy Policy.

11. Disclaimers

  • AfroCal is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.
  • Nutritional information is estimated using AI and public food databases and may contain inaccuracies.
  • We are not responsible for any health decisions made based on information provided by the app.
  • As a beta service, AfroCal may experience downtime, data loss, or unexpected behaviour. We are not liable for any consequences arising from beta-phase instability.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Bryte Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, health-related outcomes, or loss of profits, arising from your use of or inability to use the app.

Our total liability for any claim arising from or related to these Terms shall not exceed the amount you paid for the app or any subscriptions in the 12 months preceding the claim, or $50 USD, whichever is greater.

Consumer rights notice: Nothing in these Terms limits or excludes rights that cannot be excluded by law, including statutory consumer guarantees under Australian Consumer Law, rights under the Consumer Rights Act 2015 (UK), or rights under applicable EU consumer protection laws.

13. Indemnification

You agree to indemnify and hold harmless Bryte Labs, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the app in violation of these Terms, or from your infringement of any third-party rights.

14. Account Deletion and Termination

  • You may delete your account at any time directly within the app (Settings → Delete Account). This permanently and irreversibly removes all your data from our servers.
  • You may stop using the app at any time by deleting it from your device. Uninstalling the app removes all locally stored data.
  • We may suspend or terminate your access to the app at any time, with or without cause or notice, if we believe you have violated these Terms.
  • Upon termination, your right to use the app ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will survive.
  • If we terminate your access without cause, we will provide a reasonable opportunity to export your data upon request.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the app and by updating the "Last updated" date. For significant changes, we may require you to re-accept the Terms before continuing to use the app. Your continued use of the app after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the app.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Bryte Labs is established, without regard to conflict of law principles.

  • EU/UK users: Nothing in these Terms affects your rights as a consumer under mandatory EU or UK consumer protection laws. You may bring proceedings in the courts of your country of residence.
  • Australian users: These Terms are subject to the Australian Consumer Law where applicable. You may contact the ACCC or your state consumer protection agency for guidance.
  • Dispute resolution: We encourage you to contact us first at hello@brytelabs.co to resolve any dispute informally. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration or the courts of the applicable jurisdiction.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bryte Labs regarding your use of AfroCal and supersede any prior agreements on that subject matter.
